  • your current immigration status;
  • the eligibility category on your old EAD, if you have one;
  • the category requested on the new Form I-765 receipt notice;
  • whether this is an initial filing or a renewal.

Short answer

USCIS says you may request work authorization through Form I-765, but the right to work depends on your immigration classification, not on the fact that you mailed the form. In most categories, an initial I-765 filing means you wait for approval and the card.

A renewal may be different. USCIS provides an automatic-extension list for certain categories, and many listed renewals can continue for up to 540 days while the renewal is pending. USCIS also says some categories, such as TPS renewals, have separate duration rules.

Step-by-step process

1. Ask whether your status already authorizes employment

USCIS explains that some classifications are work-authorized based on status, while others require a separate EAD. Start with the classification itself. If the status is not independently work-authorized, filing I-765 alone usually does not solve the problem.

2. If this is a renewal, compare the category carefully

The USCIS automatic-extension page is category driven. The key evidence is usually the old EAD category and the class requested or eligibility category on the I-797C receipt notice. A receipt notice helps only if your renewal actually fits the extension rules.

3. Treat initial filings more cautiously

For most first-time applicants, the safe assumption is that you wait until USCIS approves the request and the employment authorization document is issued, unless your underlying status already authorizes work.

4. Do not confuse card production with case filing

Approval, card production, card delivery, and Social Security number follow-up are separate events. USCIS notes on the I-765 page that some applicants may still need to visit the Social Security Administration after EAD approval.

5. Plan for delivery problems and card errors

If the card is not delivered or contains a USCIS error, USCIS has separate correction and reissue procedures. That is different from simply checking case status.

A receipt notice is not universal work permission

Many people treat a filing receipt like temporary work approval. That is wrong in categories that do not qualify for automatic extension.

Renewal categories can still expire

Even if you qualify for an automatic extension, the extension is limited by USCIS rules and, in some categories, by the underlying status period itself.

Delivery problems can block lawful work in practice

A favorable decision is helpful, but employers still care about document evidence. A non-delivered or incorrect card can become a practical work problem fast.

Sometimes the real fix is a different status path

If your current classification does not permit work, the better solution may be a status change, a different underlying benefit request, or an employer-filed immigration path instead of assuming I-765 alone can bridge the gap.
